Three of the six sex offenders who did not attend a Halloween night gathering as ordered will face new criminal charges, authorities said Tuesday.The three probably did not attend because they already had been accused of violating probation and realized they were in trouble, said George V. Kirk, supervisor of the Frederick field office of the state Division of Parole and Probation.
One of the three absentees recently had his supervision transferred to Frederick County from Montgomery County.
Three others who did not attend the event were excused and do not face any punishment, Kirk said.
Two of them presented documentation they were working. The third was unable to attend because he was in jail, Kirk said.
"With these guys it's a pattern," Kirk said of the three for whom his agents are requesting arrest warrants.
Kirk did not identify them Tuesday because criminal charges have not been filed.
He said the three will be charged with failure to report to their probation agent as directed and to follow their lawful instruction.
If any of the men are convicted, his penalty will be up to a Frederick County Circuit Court judge.
A judge could impose any previously suspended prison terms.
Kirk said the event was a success. Sixty-eight of the 74 sex offenders ordered to attend showed up.
"They were well-behaved. They watched the video attentively," Kirk said. "We kept them off the street for 21Ú2 hours."
Assistant State's Attorney Lindell K. Angel said that violations are taken seriously. Those directed to attend have been convicted of victimizing children in a sexual way.
"She reminded them that ignorance to the law isn't an excuse," Kirk said. "Especially because we have them on record as being there (at the gathering)."
