The contentious subject of illegal immigration and how to tackle its effects on a local level has not stayed for long off the minds of county commissioners.

On Tuesday, Commissioners Charles Jenkins and John L. Thompson Jr. and Frederick County Sheriff Chuck Jenkins introduced a plan to force the FrederickCounty Board of Education to provide commissioners with a count of students whose legal presence in the country cannot be reasonably determined.

The plan was among several under consideration to be introduced in the county's 2010 state legislative package.

If approved by the full board of commissioners next week, the proposal will go to the county delegation of state lawmakers for approval.

Successful proposals will be introduced in the Maryland General Assembly during the 90-day regular session that convenes in January.

In October 2008, county commissioners voted to ask whether a local school system could collect data "to support the proposition that a student is lawfully present in the United States."

In March, the state board of education ruled in part that unless the school system has a valid reason, officials cannot seek immigration status of students.

Commissioner Jenkins said the school system receives more than half the county's budget and so is an important area to understand the cost of undocumented students.

"We've got to start somewhere," he said.

Jenkins said he did not think collecting the information would be a burden on school officials, or an unfunded mandate.

"Until we stop making this an attractive place where everybody who gets rewarded for breaking into our country É it starts at the local level," he said.

Gary Brennan, president of the Frederick County Teachers Association, spoke out against the proposal at the commissioners' meeting.

"In effect, this proposal would force the Board of Education into an administrative role for which it is entirely unequipped," he said.

Brennan thinks federal agencies designed and trained to determine immigration status should be the ones to do so.

"This is a poorly developed and unfunded mandate that will provide data with no clear benefit or application," he said.

He also said the proposal could have a chilling effect on some students and families who may become concerned about attending school.

"Public schools have a legal and moral obligation to educate any students who come through their doors," he said.

Thompson said that, for the most part, the proposal would not ask students or their parents for more information than the school system already does.

The idea, he said, is not to determine who is in the country legally or illegally, who is a citizen and who is not.

The proposal has nothing to do with who gets educated or not, he said.

Instead, the plan is to get a rough count of people whose legal presence can't reasonably be determined, and then to give the number to federal officials.

"The more opposition I hear from people, the more concern I have that the number's a lot higher than we think," he said.

Frederick County delegation Chairman Paul Stull said it was too early in the process to determine how the delegation may vote on such a proposal.

He said he has been approached by some citizens who expressed their concerns about how many tax dollars are going to educate illegal immigrants.

FCPS teachers recently had to fill out ethnicity forms focused mainly on whether they are hispanic or not.

I do not think this is an unreasonable request. People here legally should have no problem about giving out this information. Thoes here ILLEGALY do not belong here in the first place. Why should my tax dollars pay for an education they're NOT entitled to. The money spent on illegal students is taking away from every child that is here legally. Mine yours and those families who went through the process to be legal residents. THEY are the ones who should support this and other measures to enforce immagration laws. Why should illegals get a free pass ? Brad Jones

That doesn't seem to stop them with all the feel good social programs they cram down the kids throats instead of academics.

To the best of my knowledge, none of the delegation members had any interest in pursuing the proposal.

If a student from WV drove across the river to get a better education and the FCPS found out, they would boot him out. What is the difference here? WV doesn't pay school taxes as well as most illegal immigrants?

Wow, I'm here legally and I don't pay "school taxes". I do pay income tax and sales tax and property tax. If you live here, you can't avoid paying tax. As a previous poster has said this is a non-starter, except someone getting their election campaign for next year started. Also specifically what are the social programs the schools are ramming down my child's throat? I haven't seen any of that either.

For those of you who think this is a waste of time, please send me $100. I could use the money. You shouldn't have a problem giving your money away to me for no apparent reason, should you? You are already doing it by giving a free education to illegal residents, so why should you have a problem giving $100 to a legal resident who has paid his taxes and worked to better the community? I'm waiting . . .

The Commissioners are curiously timid about dealing with this issue, with the exception of Comm. Jenkins. They sure are not concerned about the taxpaying citizens, are they? I have contacted various commissioners and all they say is--it's not our problem, it's a federal problem. Do we need to follow the money?

Illegal immigration would not be such a big a problem if there were no jobs for them in the US. I do not think that all the construction companies and restaurants are owned by democrats and liberals. These fine 'merican businessmen are lining their pockets based on cheap illegal labor. They are the ones that should be rounded up, not some semiliterate drywall hanger or dishwasher. If someone knowingly uses illegal labor, their business should be shut down and their Hummer repossessed.

Here we go again . Point one -This entire proposal is based on a unproven assumption that undocumented residents cost the rest of us legal rsidents by using services and not paying taxes . The majority of County revenues comes from the real estate tax and everyone has to pay that one way or another .Undocumented residents pay sales and gas tax just like everyone else . Undocumented residents often have income taxes withheld by their employer but never file a return and get a refund . Perhaps there are some who work under a cash encnomy who don't pay income taxes . If that is the case I say go after those who pay them . Point two- I seriously doubt that Frederick County can give a reliable estimate of County employees who are here legally . I doubt if any depatnment of County Government can give an estimate of the number of illegals using County services. Will Lenny Chuck and Charles ask the Parks and Rec Dept to give them a best guess ? How about the Health Dept , Head Start , Housing Office , Transit ?
