Discretionary stops are those that don't involve radar, laser or Visual Average Speed Computer and Recorder technology. Police agencies are not legally required to record data on these traffic stops, including those made during checkpoints, roadblocks or emergency situations.
Discretionary searches do not include searches made following a driver's arrest, which are required by law.
